Rule 8 Conduct and Discipline
8 CONDUCT AND DISCIPLINE
8.1 Code of Conduct
This Code indicates the standard of conduct which all
members of the Institute are required to observe.
Any member whose conduct is contrary to this Code, or to
any standards and rules set by the Board of Management from time to time,
may be liable to disciplinary action as provided in the Institute’s
Rules.
Members of the Institute are bound, by this Code, to give
advice wisely and honestly, and to work in a professional manner.
All members are responsible as follows:
Article I
to be of constructive service to the public in civic
affairs and to apply their skills to the responsible and economic
development of their community;
Article II
to provide professional services of a high standard;
Article III
to inform their clients or employers of the existence or
likelihood of any conflict between their personal interests and those of
their clients or employers;
Article IV
to
act with fairness and impartiality;
Article V
to maintain the highest standards of integrity in their
professional activities and in their dealings with the Institute and
fellow members;
Article VI
to promote the advancement of Value Management;
Article VII
to conduct themselves in a manner which is not derogatory
to their professional character, nor likely to lessen the confidence of
the public in the Institute or the Value Management profession nor bring
them into disrepute;
Article VIII
to
compete fairly with other members.
8.2 Disciplinary Action
The Board of Management, on the recommendation of its
Executive, is empowered to commission an investigation by an investigating
committee (which may comprise the Board’s Executive or the Membership
Committee or any other people it considers appropriate) into the
activities of any member or Corporate Affiliate which are believed on
reasonable grounds to contravene the Institute's Code of Conduct.
The matters which are the subject of any investigations
shall be retained in the strictest of confidence by the Board, its
Executive and Investigating Committee, and the member or Corporate
Affiliate against whom a complaint has been made until a finding is
reached and all appeals in accordance with the Institute’s Rules have
been exhausted.
The Investigating Committee on the basis of its findings
and the information and representations made by the member or Corporate
Affiliate may recommend to the Board and the board may take such
disciplinary action as it deems appropriate in all the circumstances,
including but not limited to the expulsion or suspension of the member or
Corporate Affiliate from membership of the Institute.
Members or Corporate Affiliates who are the subject of
such investigations into their conduct have the right of representation
and appeal to the Board of Management against any disciplinary action
decided upon, on the clear understanding that any and all of the costs
incurred in respect of such representations and/or appeal are borne entirely by the subject member or Corporate
Affiliate.
The Chairperson of the Investigating Committee shall
report to the Board and answer questions but shall not take any further
part in any proceeding as a member of the Board of Management, where
representations or an approval or an appeal is being considered that
relates to any disciplinary action recommended by the Investigating
Committee.
8.3 Removal of Unfinancial Members
The Board of Management may cancel the membership of any
Personal Member or Corporate Member whose subscriptions or fees are in
arrears and where, in the opinion of the Board upon the recommendation of
its Executive, there is little prospect of the due subscriptions or fees
being paid within a time that the Board or its Executive considers
reasonable.
Any member so removed shall be advised accordingly.
